Save Our County thanks New Castle County residents for their interest, concern and support in SOC's lawsuit over the "Commercial Regional" rezoning of Barley Mill Plaza.
After winning the 2013 judgment in Chancery Court, which overturned the rezoning by New Castle County Council, we defended that decision in the Delaware Supreme Court in response to an appeal by the developer.
We are delighted to report that on March 25, 2014, the Supreme Court affirmed the lower court's decision.
Our serious concerns about the future of Barley Mill Plaza -- many of which still must be resolved -- are detailed in the "Issues" section of this web site.
Fighting for Integrity and Transparency in Land Use Planning in New Castle County, Delaware
Why We Exist: Some have asked: What does SOC hope to accomplish?
We are seeking -- and will continue to seek-- informed, unbiased and very clear public discussion, understanding, and decisions related to land use planning in New Castle County.
Specifically, related to the development of Barley Mill Plaza, our court case sought clarity about:
(1) whether the "CR" rezoning should have been approved by County Council;
(2) the impact of additional traffic, based on the developer's proposal;
(3) the scope of road improvements made necessary by any proposed project;
(4) who would pay for necessary improvements.
